Terms and conditions for using our security services.

Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "Customer") and E. Security Alarm Systems, Inc. ("we," "us," "our," or "Company") concerning your access to and use of our security services.

By accessing our services or website, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our services.

Services Provided

E. Security Alarm Systems, Inc. provides professional security alarm services, including:

  • Security system installation and configuration
  • Intrusion detection system installation
  • Video surveillance system setup
  • Access control system installation
  • Maintenance and repair services
  • Professional 24/7 monitoring services

The specific services provided will be detailed in your service agreement or work order.

Service Agreements

All services are subject to a written service agreement. By signing a service agreement, you agree to:

  • Pay all fees as specified in the agreement
  • Provide accurate property and contact information
  • Grant necessary access to your property for installation and service
  • Notify us of any changes to your property or contact information
  • Comply with all applicable laws and regulations

Payment Terms

You agree to pay all fees associated with our services according to the following terms:

  • Installation Fees: Due upon completion of installation unless otherwise specified.
  • Monthly Monitoring: Billed in advance on a monthly basis.
  • Service Calls: Billed upon completion of service.
  • Equipment: Payment required before installation unless credit terms are approved.

Late payments may be subject to late fees and service interruption. All payments are non-refundable unless otherwise stated in writing.

Equipment and Warranties

Equipment installed by E. Security Alarm Systems, Inc. is subject to:

  • Manufacturer Warranty: Equipment is covered by manufacturer warranties, which vary by product.
  • Labor Warranty: Installation labor is warranted for one year from installation date.
  • Warranty Exclusions: Damage caused by misuse, modification, or unauthorized repairs voids warranty coverage.

Equipment installed remains the property of the customer unless otherwise specified in a lease agreement.

Monitoring Services

If you subscribe to our monitoring services:

  • Monitoring is provided 24 hours per day, 7 days per week.
  • We will dispatch emergency services when alarms are activated.
  • False alarms may result in charges from local authorities.
  • You must maintain a valid call list with current contact information.
  • Monitoring may be temporarily interrupted for system maintenance.

Limitation of Liability

E. Security Alarm Systems, Inc. provides security services but does not guarantee:

  • Prevention of all security incidents or losses
  • Uninterrupted operation of security systems
  • Error-free operation of equipment
  • Specific response times from emergency services

Our liability is limited to the lesser of: (a) the amount paid for services in the 12 months preceding the claim; or (b) the actual damages incurred. We are not liable for indirect, incidental, or consequential damages.

Customer Responsibilities

As a customer, you agree to:

  • Maintain your security system in good working order
  • Test your system regularly according to our guidelines
  • Notify us of system malfunctions or damage
  • Keep emergency contact information current
  • Obtain required permits for alarm systems in your jurisdiction
  • Respond promptly to alarm notifications

Termination

Either party may terminate services according to the terms in your service agreement. Generally:

  • Monitoring services require 30 days written notice for termination.
  • Early termination may result in termination fees.
  • Outstanding balances must be paid upon termination.
  • Equipment installed remains with the property unless leased.

Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of E. Security Alarm Systems, Inc. or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without written permission.

Privacy

Your use of our services is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information.

Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through:

  • Good faith negotiation between the parties.
  • If negotiation fails, mediation in Broward County, Florida.
  • If mediation fails, binding arbitration in Florida.

The prevailing party is entitled to reasonable attorney fees and costs.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify customers of significant changes. Your continued use of our services after changes constitutes acceptance of the modified Terms.
